Dear aspCam users,
This Agreement is an agreement entered into by aspCam Users (" Users ") with respect to the use of the Automatic Renewal Commission Deduction Service (" The Service ") provided by aspCam.
This Agreement describes the rights and obligations of aspCam and Users with respect to the use of the Service. "User" and "You" shall mean an individual enjoying the Services provided by aspCam. This Agreement constitutes a prerequisite for Users to use the Services provided by aspCam. Unless Users accept the terms of this Agreement, Users may not use the Services, and Users who choose to use the Services shall be deemed to agree to be bound by the terms of this Agreement.
[Note] You will be deemed to have read, understood and agreed to sign this Agreement by clicking Agree, accept or Next, or by purchasing/opening the automatic renewal Membership Service.
I. Confirmation and acceptance of continuous monthly service terms
The ownership of all network services and related intellectual property rights related to the continuous monthly subscription service shall be owned by aspCam in accordance with the law and protected by the laws of the People's Republic of China and international conventions. The terms of this Service Agreement apply to all aspCam Network Services, and users shall be bound by the terms of this Service Agreement upon completion of the registration process and commencement of the automatic renewal of services provided by aspCam.
Once the Agreement is modified, aspCam will release the modification through system prompts and/or information push and/or background announcements. Please read the modification carefully. If you have any problem with the modification of the Agreement, you may stop using the Service and consult the customer service. However, it is necessary to remind you that the updated Agreement shall take effect from the date of release of the updated version.
Ii. Instructions on automatic renewal Service
1. The Service is based on users' demand for automatic renewal, and is launched to avoid losses caused by users' failure to renew timely due to negligence or other reasons under the premise that users have opened the Service. After opening the service, the user authorizes aspCam to entrust the payment channels (such as Alipay and wechat) to withhold the fees of the next billing cycle 24 hours before and after the expiration of the automatic renewal period of the member. Part of the withholding period shall be determined by the operators or payment channels according to the actual situation, and the actual withholding time shall be subject to such channels as ios channels. Users who choose automatic renewal agree to deduct the next billing cycle from their accounts without verifying the member account password, payment password, SMS verification code and other information. Once the deduction is successful, aspCam will initiate the membership service for the next billing cycle, and will record the deduction in the member's payment record on the date of the successful deduction, and extend the member's service period accordingly. This service is implemented if the user has tied his aspCam user account to the above account and can successfully deduct from the above account. Billing period: Monthly, quarterly, annual, etc. (subject to aspCam), members can choose.
2. Automatic renewal refers to the method of deducting the user's fees for the next billing period through the above account in accordance with Article 1. Users must ensure that aspCam can successfully deduct from the above account. Users shall be solely responsible for the renewal failure caused by other reasons such as insufficient deductible balance of the account.
3. All intellectual property rights related to or may be derived from the Automatic renewal Service are legally owned by aspCam, and Users shall not automatically acquire any or all of their rights by using the Automatic Renewal Service.
4. aspCam will continue to improve the quality of service and modify the terms of Service in accordance with the adjustment of its products and services and changes in the relevant laws and regulations of the People's Republic of China. aspCam reserves the right to update the service agreement at any time and to prompt prompt notifications.
Iii. Validity period and termination of the Automatic Renewal Service Agreement
1. This Agreement shall come into force after the user chooses to accept and use the Service. Unless aspCam or the User voluntarily and explicitly cancels the automatic renewal, the automatic renewal service received by the User is deemed to continue in effect without a limited number of times.
2. Users have the right to terminate the Service at any time. You can cancel the Service in the following ways:
(1) AppleID Purchase:
iOS12 or later: Open "App Store" on Apple iOS device → click your Apple account profile picture in the upper right corner → Enter "Account" → click "Subscribe" → select aspCam and unsubscribe;
Under iOS12: Open "Settings" on Apple iOS device → Go to "iTunes Store and App Store" → click "Apple ID" to view Apple ID→ Go to "Account Settings" page → click "Subscribe" → Select aspCam→ Unsubscribe.
(2) wechat and Alipay purchase:
Operate directly on wechat and Alipay clients. The specific operation method is subject to wechat and Alipay clients.
Upon termination of the Service, aspCam will stop providing users with the relevant content of the Service.
3. The instruction that the user entrusts aspCam to automatically renew the fee deduction before terminating the Service is still valid. Once the fee deduction is successful, aspCam will open the corresponding membership service for the billing period for you.
Iv. Rights and Obligations of both Parties of the automatic Renewal Service
1. The fees deducted by aspCam in the next billing cycle shall be recorded in the user payment record and the validity period of the corresponding service shall be extended at the same time.
2. In case of any problem in the process of fee deduction, aspCam shall work closely with the user to find out the cause and bear the loss caused by its own fault; If the loss is caused by the unequal fault of both parties, both parties shall bear the corresponding degree of liability according to the degree of fault. If both parties are jointly responsible, they shall share the responsibility equally.
3. Users can choose whether to cancel the Service or not. If Users do not cancel the service, Users shall be deemed to agree with aspCam to continue to renew and deduct fees in accordance with certain rules (long-term valid and not limited by the number of times). Once the deduction is completed, aspCam will open the service for the next billing cycle.
4. In the event of any adjustment of the aspCam service price during the automatic renewal period, the price currently in effect shall prevail.
5. aspCam shall not charge any fees for the Service, but aspCam shall have the right to decide whether to charge fees for the Service itself or adjust the automatic renewal period and fees based on future business needs or market changes.
v. Refund
aspCam reminds users that when a user uses the automatic renewal service and entrusts aspCam to deduct the payment from the user's default payment channel, aspCam will consider that the user has chosen to subscribe to aspCam's paid services. VIP membership is non-refundable once opened. In the event that you are completely unable to use the VIP member service due to major defects, or in the event that aspCam breaches the contract, otherwise agreed in this Agreement, refunds are required by laws and regulations or aspCam agrees to refunds, etc.
aspCam would like to remind you that you should carefully check your account information, service content, price, and service duration before purchasing an automatic renewal service.
Vi. Guarantee of legitimacy
The User acknowledges and warrants that: does not use the automatic renewal service, directly or indirectly engages in the following moral behavior in violation of national laws and regulations and social order and good custom:
Violating the basic principles defined in the Constitution;
Endangering state security, disclosing state secrets, subverting state power or undermining national unity;
Harming the honor and interests of the State;
Inciting ethnic hatred or discrimination and undermining ethnic unity;
Sabotaging the state's religious policies and promoting cults and feudal superstitions;
Spreading rumors, disturbing social order or undermining social stability;
Distributing obscenity, pornography, gambling, violence, terror or inciting crimes;
Insult or slander another person or infringe upon the lawful rights and interests of another person;
Inciting illegal assembly, association, procession, demonstration or gathering crowds to disturb public order;
Activities in the name of illegal non-governmental organizations;
It contains other contents prohibited by laws or administrative regulations.
aspCam shall have the right to supervise users' behaviors related to the automatic renewal service from time to time, and shall have the right to withdraw users' right to use the automatic renewal Service without making any compensation to users once it is found that users are involved in the above behaviors in violation of national laws and regulations and the moral reservation of social public order and good custom. aspCam will report User's behavior to state authorities in accordance with the law and reserves the right to further investigate user's behavior resulting in aspCam's loss.
Vii. Prohibition of commercialization
User acknowledges and agrees that, without aspCam's formal written public permission, User may not use the Auto-renewal Services obtained by User in other areas other than aspCam Services, and may not directly or indirectly commercialize the Auto-renewal Services in any way (including, without limitation, resale, sale, equivalent replacement, etc.). If a user is found to have engaged in any of the above activities, aspCam shall have the right to withdraw the User's right to use the automatic renewal Service without any compensation to the User, and reserves the right to pursue further damages caused by the User's activities.
